62 warnings issued to employers about non-payment of ET Judgements

Section 150 of the Small Business Enterprise and Employment Act 2015 came into force on 6 April 2016. Intended to tackle late and non-payment of employment tribunal awards and settlements, it allows an enforcement officer to issue a warning and impose a fine.

The Government has confirmed 62 warning notices have been served but as yet no fines have been imposed.

A warning notice can be issued where a complaint is made about an award that has not been  unpaid after 42 days. Penalty notices (issuing a fine) can only be issued 28 days after the warning notice.

The maximum fine is £5,000 payable to the Government in addition to the employment tribunal award.

A total of 14 penalty notices are due to be issued imminently if the relevant employer fails to pay.
